And the dev used to credit an artist on their website, but took them down after they ran with his money without any art.

Except they do not, it's called "fair use," and all the arts community decided to apply that to themselves the first moment they uploaded it to the Internet. The fact that they didn't expect it would work backwards, one day, is not an excuse to call it illegal (read a law book and find me where it is illegal, otherwise you just love to spout nonsense).
But when THEY were using it to make "Yaoi fanarts of Batman (copyrighted character) taking it in the Batcave with the Riddler's cane," was all fine and dandy, right?
You... Know that the art is only a small part of the game, right? Do you have any idea how long it takes to write a cohesive story or program it with different choices and dialogue?
3D assets are often released under CC0 or CC-BY licenses. They can be used freely by other developers and are intentionally released that way.
